Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of OpsHero's AI automation platform and services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
Service Description
OpsHero provides custom AI automation solutions including:
- Custom AI agent development and deployment
- Workflow automation tools
- Enterprise integrations
- Discovery and consultation services
- Ongoing support and maintenance
User Accounts
Account Creation
To use our Services, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
Account Restrictions
You may not:
- Share your account with others
- Use the Services for illegal purposes
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
Payment Terms
Fees
Custom pricing is provided based on your specific requirements. You agree to pay all fees as outlined in your service agreement.
Billing
- Fees are billed according to your service agreement
- All fees are non-refundable unless otherwise stated
- Late payments may result in service suspension
- We reserve the right to change fees with 30 days notice
Intellectual Property
Our Property
The Services, including all software, content, and trademarks, are owned by OpsHero, Inc. and protected by intellectual property laws.
Your Data
You retain all rights to your data. By using our Services, you grant us a limited license to process your data solely to provide the Services.
SMS & Text Messaging Services
OpsHero provides two-way customer support and service communications via SMS. This is not a marketing program — messages are limited to support responses, requested information, and service updates.
Consent
You opt in to receive SMS messages by: (1) texting OpsHero's published phone number, or (2) verbally requesting SMS follow-up during a phone call, confirmed via a double opt-in confirmation text. Consent is not a condition of purchase.
Message Frequency & Cost
Message frequency varies, typically 1–5 messages per support interaction. Message and data rates may apply.
Opt-Out & Help
Reply STOP at any time to opt out of SMS messages. You may also reply UNSUBSCRIBE, QUIT, CANCEL, or END. Reply HELP for assistance, or contact support@opshero.ai.
Privacy & Data Sharing
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details.

Carriers are not liable for delayed or undelivered messages.
Data Processing
We process your data in accordance with:
- Our Privacy Policy
- Applicable data protection laws (GDPR, CCPA, etc.)

- Your specific data processing agreement
Service Level Agreement
We strive to provide:
- 99.9% uptime for production systems
- 24/7 emergency support for enterprise customers
- Regular maintenance windows with advance notice
- Incident response and resolution procedures
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPSHERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Indemnification
You agree to indemnify and hold harmless OpsHero from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
Termination
Either party may terminate the service agreement:
- With 30 days written notice
- Immediately for material breach
- Immediately if required by law
Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance.
